Worcester area wrong-way crash takes life of woman

On Behalf of | Aug 1, 2013 | Wrongful Death

The unexpected and untimely loss of a loved one because of the careless actions of another can be one of the most difficult experiences a family can suffer. It is not only a difficult time but it can be a long process for the family to recover from their loss and the financial burdens they are left with.

A Massachusetts man was recently arrested for driving the wrong way and causing a multi-vehicle accident, which led to the death of a 66-year old woman. The woman was pronounced dead at the scene of the accident and the driver was transported to a hospital in Worcester with non-life threatening injuries.

According to witnesses who called in the incident, the man was driving west in the eastbound lanes shortly before the fatal car crash. Two other victims from a different vehicle involved in the multi-car fatal accident were taken to the hospital for their injuries. An official noted that the cause of the accident remains under investigation but did not rule out alcohol as a factor.

A wrongful death cause of action can be brought by surviving family members against a negligent driver following the loss of a loved one. The surviving family members may be able to recover compensation for the costs and losses the family has suffered. Damages can include those for loss of support and services, loss of companionship and pain and suffering damages. An example can include the loss of a stay-at-home mother who can no longer offer guidance and support services to her family following a fatal accident.

A successful wrongful death cause of action will require the victim’s family to establish the negligence of the party being sued for the wrongful death. In cases when the negligent driver has received a citation related to the fatal car crash or has been arrested on charges related to the fatal accident, either are typically evidence of negligence in the accident.

A negligent driver responsible for the horror associated with losing a loved one unexpectedly and wrongfully may be liable to the family of the lost loved one for damages. Seeking out advice can help a family determine what options are available during a difficult time.
